The O visa is reserved for individuals with Extraordinary Ability or Achievement coming to the United States to work temporarily in your area of extraordinary ability.

O Visa

Extraordinary ability in the fields of science, education, business or athletics means a level of expertise indicating that you are one of the small percentage who have arisen to the very top of the field.

Application Process

Your U.S. employer, U.S. agent, or foreign employer through a U.S. agent should file a Form I-129, Petition for Nonimmigrant Worker on your behalf, along with the required evidence and fee according to the form instructions. Your employer or agent cannot file the petition more than one year before they actually need your services.

Family and Support Staff

Your eligible spouse and children under 21 may accompany you to the United States. They are not allowed to work in the U.S. but are allowed to study. Support staff who play an integral part in your work can also accompany you. Generally, these individuals are also allowed to have their eligible spouses and children join them in the United States.
