The EB-4 Petition Process
In most cases, employers are responsible for filing a Form I-360 Petition for Amerasian, Widow(er), or Special Immigrant on behalf of the employee. However, certain employees have the option to self-petition without needing an employer, and a Labor Certification is not required for this category.

However, self-petitioning is also an option for certain employees, eliminating the need for an employer. Worth noting is that a Labor Certification is not required for the EB-4 visa category.
