- Indefinite Renewals – The E-2 visa can be renewed indefinitely as long as the business continues to meet the qualifications.
- Substantial Investment – The investment must be significant in proportion to the total business cost and enough to ensure its success.
- Active Involvement – Investors must be actively managing the enterprise, not just passively investing.
- At Risk Capital – The investment must be at risk of loss, meaning funds must already be committed to the business.
- Viable Business – The business must generate enough income to support the investor and their family, not just provide minimal financial returns.
