juridical concept about visa waiver program with phrase on the sheet

Do I Qualify?

To qualify for the VWP, you must meet the following requirements:

  • Passport: Your passport must be valid, machine-readable, and an e-passport (containing a digital chip).
  • Purpose of Travel: Your visit must be for business or tourism purposes. Other activities like studying, working, or seeking permanent residency are not permitted under the VWP.
  • No Visa Ineligibilities: You must not have any ineligibilities that would prevent you from obtaining a U.S. visa.

While the Visa Waiver Program offers a convenient pathway for short-term visits to the United States, understanding and navigating the eligibility criteria can be complex. This is where the assistance of immigration attorneys at IBP Immigration Law becomes invaluable.

Important Considerations

While the VWP offers convenience, there are certain limitations to be aware of:

  • Duration of Stay: Your visit cannot exceed 90 days.
  • Ineligibility Factors: Previous criminal convictions, overstays on prior U.S. visits, or travel to certain countries might make you ineligible for the VWP.
  • ESTA: Your ESTA approval does not guarantee entry into the U.S. Ultimately, border officials determine your admissibility upon arrival.
