Yes. You do not need to be physically in the U.S. to file an EB-1A, EB-1B, NIW, or O visa petition. If you are abroad, the process typically involves consular processing after your petition (such as an I-140 for EB-1A or EB-1B or NIW) is approved, and a visa number becomes available. For O visas, once your petition is approved, you would apply for the visa at a U.S. consulate or embassy in your country.
Each type of petition will require different documents to meet the eligibility requiems. For an EB-2 NIW, you will need to prove that you have an advanced degree (Bachelor’s plus 5 years of Progressive professional experience, a master’s degree, or a Ph.D.). You will also need evidence to show your work is in the national interest and has broad impact.
For EB-1As, you will need evidence of at least 3 out of the 10 extraordinarily ability criteria. These may include publications, scholarly articles, citation records, testimonial letters, etc.
